Megawheels, Ebay und das Garantieversprechen

Für ein Foto-/Filmprojekt auf einer Mittelmeerinsel habe ich ein Elektroklapprad angeschafft, klein genug, um es im Auto mitzunehmen aber stark genug für die Steigungen, die es jedes Mal zu bewältigen gab, wenn man von einer Seite der Insel auf die andere wollte. Da gab es Steigungen bis 30 Grad. Über Ebay habe ich ein Fahrrad der Firma Megawheels gekauft, die in Großbritanien ansässig ist, aber scheinbar nur die Niederlassung eines Chinesischen Händlers.

Das Rad fuhr gut, 15 km weit, dann begann der Pedal Arm (Kurbel), bei den Tretbewegungen auf der Achse zu wackeln. Die Kurbel ist ein Gußteil mit einer konisch zulaufenden Vierkantöffnung, in der sie auf die Tretlagerachse gesteckt und mit einer M10 Imbusschraube verschraubt wird. Die Vierkantöffnung war bei meinem Fahrrad von so schlechter Qualität, das die Kurbel mit Pedal auf der Achse wackelte und dadurch die Imbusschraube sprichwörtlich aus dem Gewinde trieb. Alle 500 Meter musste ich die Kurbel wieder festschrauben, um sie nicht zu verlieren.

All Megawheels products are covered by our manufacturer's 1-year all-inclusive warranty for all manufacturing defects to the original owner (the warranty period of the accessories is specified separately). This Warranty starts on the date of your purchase and lasts for one year ( the “Warranty Period” ). The Warranty Period is not extended if the Product is repaired or replaced.
Refund-refundable items must be returned within 7 days after delivery. In no case will we give a refund 7 days after delivery of the product.

Garantie

Für alle Megawheels-Produkte gilt die 1-jährige Pauschalgarantie des Herstellers für alle Herstellungsfehler gegenüber dem Erstbesitzer (die Garantiezeit des Zubehörs ist separat angegeben). Diese Garantie beginnt mit dem Datum des Kaufs und dauert ein Jahr (die "Garantiezeit"). Die Gewährleistungsfrist wird nicht verlängert, wenn das Produkt repariert oder ersetzt wird.

Erstattungsfähige Artikel müssen innerhalb von 7 Tagen nach der Lieferung zurückgeschickt werden. In keinem Fall gewähren wir eine Rückerstattung 7 Tage nach Lieferung des Produkts.

Der Mailverkehr über den Schaden auf Ebay (das Gute an Ebay ist ja, dass man den Verkäufer eigentlich gar nicht genau kennt) lief folgender Maßen ab:

Ich habe am 26, Juni 2021 ein Faltbares Elektrofahrrad 14 Zoll 250 W bei Ihnen gekauft. Ich habe es nach dem Kauf für 2 Monate mit ins Ausland genommen. Leider ist schon nach kurzer Zeit (10km) ein Mangel aufgetreten. Das rechte Pedal hat fest mit der Achse verschraubt, viel Spiel. Ist es fest angezogen dann lockert sich beim Treten die Schraube und nach 500 Metern muss man die Schraube wieder fest anziehen, will man sie nicht verlieren.
Die Vierkantöffnung am Pedal ist mangelhaft, passt auf die Achse hat aber extrem viel Spiel.
Zur Behebung des Fehlers würde ich Sie bitten, mit ein Pedal mit passgenauer Öffnung als Ersatzteil zu senden. Sollte sich dadurch der Fehler nicht beheben lassen, möchte ich das Fahrrad zurückgeben.

The pedl is a casting. The opening for attaching to the axle is poorly made and has an extremly large amount of play. This can not be repaired. You could only weld it together. The easiest way is a new pedal with a precisely fitting opening for screwing onto the axle. Best Hans.

The bicycle repair shop says they need the spare part. The defective part will never work. It is made incorrectly. Such a thing should be sorted out from the quality control.
A suitable part in Germany as a custom-made costs more than the bike. So please send me a spare part so I can get the bike fixed. Otherwise I would have to send the whole bike back to you at your cost, with a full refund of the purchase price.

It is not my problem, if the part is in the warehouse. They can send it directly from China to my adress; and please give me a date.
If this is not possible, I have to return the bike.

German cranc arms are 170mm; the cranc arm on your byce is 150mm. You can order one in GB on ebay: https://www.ebay.de/itm/3843.......................
and try if it fits and send it to me. Than I can bring it to the repair shop.

Please stop writing to me, I shoud go to a repair shop. Send me the spare part.

Zum Schluss die Frage: Was tut Ebay? Nichts. Wie alle Plattformen duckt sich das Unternehmen in Problemfällen weg und trägt keine (Mit)Verantwortung. 90 Tage nach dem Kauf kann man eine Aktion nicht mehr nachverfolgen und wenn ein Schaden eintritt, dann sind alle Kontaktmöglichkeiten zum Verkäufer gelöscht.
